As of July 1, 2025, significant reforms to New South Wales (NSW) strata legislation are set to commence, marking the second phase of a comprehensive overhaul aimed at enhancing transparency, accountability, and governance within strata schemes.
Key Changes Effective July 1, 2025:
1. Increased Disclosure Obligations for Strata Managers
Strata managing agents will be required to disclose any affiliations with suppliers and developers, including details of commissions or training services received. This aims to ensure owners corporations are fully informed about potential financial benefits the strata manager might be gaining.
2. Enhanced Strata Committee Duties and Mandatory Training
Strata committee members will have expanded fiduciary duties, requiring them to act in the best interests of the owners corporation. Additionally, mandatory training will be introduced for committee members, and failure to complete this training may result in the vacating of their office.
3. Developer Accountability for Initial Levies and Maintenance
Developers will be held accountable for initial levies and maintenance in new strata schemes. This includes providing the owners corporation with the initial maintenance schedule and estimates of contributions to the administrative and capital works fund at the first Annual General Meeting (FAGM).
4. Building Managers Duties
Building managers will also have statutory duties imposed upon them. This will increase accountability for the way that buildings are managed.
5. Enhanced Protection for Owners
NSW Fair Trading will have expanded powers to assist with common property maintenance matters, providing greater support to owners in resolving disputes.
